This exemption is expected to come into effect in early 2026. Until then, normal consenting still applies. But you can start planning now by reviewing your site and exploring design options.
What the exemption requires
- The dwelling must be 70 m² or smaller, single storey, and meet the Building Code.
- Work must be carried out or supervised by a Licensed Building Practitioner (LBP).
- You will still need to notify your council before and after construction, usually through a PIM (Project Information Memorandum). Councils can apply development contributions at this stage.
- The dwelling must meet setback and height limits and be a standalone structure with suitable services connected.
What to check on your site
Even with the exemption, not every property will automatically qualify. Before moving forward, think about:
- Services. Is there capacity for water, wastewater, stormwater, power, and data?
- Access. Can a truck and crane reach your section for delivery and installation?
- Ground conditions. Are there natural hazard overlays or geotech requirements? Are there existing underground services that might need to be relocated or worked around?
Zoning. Each council has an online GIS map or property search where you can check the zoning of your site. Many areas now allow more than one dwelling where it was not possible before. If you are not sure, we can help you interpret your zoning and understand what it means for your property.
